Terms and Conditions
Check-in time is 4:00 PM and check-out time is 10:00 AM. Non-compliance with these rules can result in eviction.
Our goal is to provide a clean, fully functional rental for every guest. These terms help keep properties in excellent condition for all. All guests must sign the Terms and Conditions at the time of booking. Your payment for the vacation rental also constitutes acceptance of these terms.
Cancellation Policy
Cancellations made up to 30 days prior to arrival will receive a 70% refund of the grand total. For reservations over $20,000 or 30+ nights, cancellations must be made at least 45 days prior to arrival to receive a 70% refund of the grand total. Eligible rental costs and protected non-rental fees will be refunded when terms are met. Excluded items, such as third‑party booking fees and travel insurance, are not refundable. Please allow up to 10 days after written cancellation for refund processing.
Beach Retreats reserves the right to cancel any reservation, with a full refund issued.
Trip Cancellation Insurance
Travel insurance is strongly recommended to protect your vacation investment. Beach Retreats, its affiliates, and the property owner(s) are not liable for Acts of Nature or other events beyond our control.
Acts of God, Hurricanes, Weather, Nature, Pandemics
In the event of a mandatory evacuation, a credit will be issued for the nights you are unable to stay; credits are valid for 12 months from the date of issue. No refunds are issued for voluntary evacuations or general travel advisories. Items left behind during evacuations are not the responsibility of Beach Retreats, its affiliates, or owners.
Construction
Construction may occur near your rental without prior notice. Views and surroundings may change. Beach Retreats is not responsible for disruptions or changes related to nearby construction.
Refunds
Refunds, when applicable, are processed no more than 30 days after the original departure date. To be eligible for consideration, you must notify Beach Retreats of any issue immediately during your stay, while you are still on property, so we can review and address it. Beach closures, public road or utility work/closures, pool closures, and Acts of God/Nature are outside of our control and are not refundable. Travel insurance is recommended.
Disputes
All concerns must be raised directly with Beach Retreats during your stay. By booking, you agree not to initiate credit card chargebacks for charges made under this agreement and expressly waive the right to do so.
Payment
A 30% deposit is due at booking. The remaining balance is due 60 days prior to arrival and will be automatically charged to the card on file unless you provide an alternative prior to that date. A valid credit card is required on file for incidentals for all reservations. If optional travel insurance is purchased, it is due in full at booking and is non‑refundable.
Taxes and Fees
All prices are subject to applicable sales and resort taxes. Each reservation includes a cleaning fee and may include administration, damage, and/or resort fees. Approved dogs require a non‑refundable pet fee; see Pet Policy.
Reservation Confirmation
If reserved by our team, a confirmation email will be sent. If booked via a travel site, that site will send confirmation. Check your spam folder and mark reservations@beachretreatsfl.com as safe if needed. Payment of the booking constitutes acceptance of these terms.
Minimum Age
The primary renter must be at least 25 years old. Unaccompanied guests under 25 are not permitted. False reservations or violations may result in cancellation or eviction without refund.
Rates and Website Content
Rates are subject to change without notice until booked. Confirmed booking rates will not change unless the guest modifies their stay. Online information is deemed reliable but not guaranteed and may contain errors or omissions.
Rental Unit Use
The registered guest is responsible for the rental unit and conduct of all occupants and guests. Only registered guests may occupy the property; subletting is prohibited. Maximum occupancy limits must always be observed. Guests are responsible for daily upkeep. Any fines or violations (e.g., traffic, noise, local ordinances) are the guest’s responsibility.
Accommodation Substitution
If your confirmed property becomes unavailable due to circumstances beyond our control (e.g., fire, damage, AC malfunction, sale), Beach Retreats may substitute accommodations. While like‑for‑like amenities cannot be guaranteed, we will make reasonable efforts to provide a comparable home. Beach Retreats, its affiliates, and owners are not liable for damages or inconvenience.
Properties for Sale
If a property is listed for sale, showings may occur during your stay and will be scheduled to minimize disruption. If a property is sold and the new owner will not honor a reservation, you are entitled to a refund or substitution within our available inventory.
Damage and Security
A non‑refundable damage waiver covers accidental damage up to $1,000 if reported prior to checkout. It does not cover intentional damage, theft, excessive cleaning, flea infestation caused by pets, unreported damage, or loss of rental income. Damage beyond $1,000 or excluded damage will be charged to the card on file. Unreported or intentional damage will be billed in full. If damages are discovered after departure, you authorize charges to your card or invoicing to the registered address.
Guests agree to pay reasonable attorney’s fees, court costs, and expenses to enforce this agreement. Jurisdiction and venue lie exclusively in the state courts of Manatee County, Florida.
Guests of Renters
Registered guests are responsible for the behavior of all members of their party and visitors. Exceeding max occupancy or holding events without prior written approval may result in immediate termination without refund.
Accidents, Injury, or Loss
Use of pools, spas/hot tubs, waterfront areas, rooftop decks, bikes, paddleboards, kayaks, and other equipment involves inherent risks. Guests assume all risks and agree to hold Beach Retreats, its affiliates, and owners harmless from any claims for accidents, injury, death, or loss of personal property.
Equipment Liability Waiver
Any equipment provided is offered without warranties as to condition or suitability. By using any equipment, you agree to assume all risks, release the “Released Parties” from all claims, and indemnify, hold harmless, and defend them from any claims arising from your use, including negligence. You are responsible for on‑time return and condition of equipment; lost, stolen, or irreparably damaged items will be charged at fair market value.
Noise Ordinance
Local noise ordinances are enforced by law. Please be considerate of neighbors. Violations may result in warnings, fines, and/or termination without refund.
Smoking
All properties are smoke‑free. Smoking anywhere in or around the accommodation (including balconies, patios, or pool areas) will incur a $200 per‑day charge; additional damages may also be charged.
Furniture and Accessories
Do not remove furniture from the unit. Blankets and bath towels must remain inside. Beach towels are provided and must be returned in the same quantities. Beach gear, bikes, and other items may be used for their intended purpose; lost or damaged items will be charged at current replacement value. Inventory is taken before and after each stay.
Pet Policy
Dogs may be allowed by prior approval only; no cats are permitted. Pet fees are not prorated. Additional charges may apply if rules are violated. Rules include:
- No animals in pools or spas.
- No animals on furniture or beds.
- Owners must pick up all pet waste on the premises and in public areas.
Unauthorized pets will result in a surcharge equal to 25% of the total reservation cost and may result in immediate termination without refund. Not all homes allow pets.
Service animal exceptions may be accommodated with prior notice and details. Knowingly misrepresenting a pet as a service animal is a criminal offense.
Limits: Maximum of 2 dogs; up to 70 lbs per pet. No aggressive or dangerous breeds or animals are allowed. Owners are responsible for any damage, medical expenses, and/or excess cleaning. Non‑compliant animals may be removed without refund.
“Dangerous dog” includes, but is not limited to: Pit Bull–type, Rottweiler, German Shepherd, Husky‑type (including Siberian), Malamute, Doberman Pinscher, Chow Chow, any Wolf‑dog hybrid, or any dog known to have previously caused injury requiring medical attention.
Equipment or Condition Failures
Report any equipment failure to Beach Retreats immediately for repair. There are no refunds for equipment failure or routine maintenance. Maintenance personnel may require access to the unit, with or without formal notice, and we will work to minimize interruptions.
Air Conditioning
Set the system to COOL and the fan to AUTO. Do not set the thermostat below 72°F and do not operate the AC with doors or windows open. Damage from improper use is the guest’s responsibility. Refer to the rental binder for local HVAC guidance.
Plumbing and Garbage Disposal
Only toilet paper may be flushed. Do not flush paper towels, wipes, feminine products, or anything else. Guests are responsible for plumbing service calls caused by misuse. Do not put peels or fibrous materials in the disposal; run plenty of water and feed items slowly.
Trash
Homes have curbside service. Place cans in the designated area as noted in your rental book and follow local pickup schedules, including recycling guidelines.
Supplies and Housekeeping
Starter supplies (toilet paper, paper towels, soaps, and similar items) are provided. Guests are responsible for purchasing additional supplies as needed. Daily housekeeping and towel service are not provided.
Termination
Failure to comply with these terms or Florida law may result in termination without refund. Florida law governs this agreement. The prevailing party in any action to enforce this agreement is entitled to attorney’s fees and costs. This is the entire agreement and may only be modified in writing signed by the party to be bound. Guests may not assign or transfer this agreement.
Illegal Activity
Use of the property for illegal purposes (including underage alcohol possession/consumption, unauthorized parties, or disturbances resulting in complaints or police response) results in immediate termination and forfeiture of all payments. If Beach Retreats or law enforcement is dispatched due to illegal activity or disturbances, a minimum $500 charge will be applied and is grounds for immediate eviction.
